GENERAL TERMS AND CONDITIONS – TRANSPORTATION

The titles used in this agreement are included for convenience only and do not limit or affect these Terms.
The CLIENT declares to have been duly informed and clarified about the terms, which they accept without reservation.

SERVICES

• The services specified herein always assume the hiring of MOOVAX for the transportation of goods and merchandise of the CLIENT (private and / or company).
• MOOVAX ensures the transportation of goods properly accommodated, packaged, and protected, though the CLIENT may waive this service by signing the respective Responsibility Agreement.
• MOOVAX only provides the service of dismantling the goods to be transported (lamps, curtains, furniture fixed to the wall or floor, etc.), with the CLIENT responsible for their assembly at the new location.
• The CLIENT may request from MOOVAX the service of assembling and installing furniture and appliances.
• The transportation by MOOVAX of electronic equipment without original packaging is dependent on the CLIENT signing this Term.
• Payment by the CLIENT shall be made at the end of each service, by ATM, mbway, ATM reference, credit card in cash, or by bank transfer upon presentation of the respective proof to the MOOVAX employee responsible for the service.

ADDITIONAL SERVICES

• MOOVAX reserves the right to apply an additional fee for the transportation of goods whose individual weight exceeds 100 kilograms (combined refrigerator, piano, safe, billiard table, etc.).
• MOOVAX reserves the right to apply an additional fee for each employee or vehicle deemed necessary to assign for the services ordered by the CLIENT.
• MOOVAX reserves the right to apply an additional fee for journeys not planned but necessary for the provision of services to the CLIENT.
• MOOVAX reserves the right to apply an additional fee for each employee assigned to the services ordered by the CLIENT that end after 6 PM.
• MOOVAX reserves the right to apply an additional fee for goods transported that were not initially ordered by the CLIENT.
• Moving items in apartments or houses that require transportation of articles by stairs has an additional cost of 25%.
• Transport services that extend beyond 6 PM have an additional cost of 25% in the first hour and 37.5% in subsequent hours.
• Services performed on Saturdays that extend after 12 PM have an additional cost of 50% in subsequent hours.
• The cost of travel is charged from and to our warehouse located at Travessa Monte de S. Gens 144, 4460-820 Custóias.

WARNINGS

• MOOVAX reserves the right to refuse service to any individual or collective person, for any reason, at any time.
• The CLIENT may not follow in the MOOVAX vehicle during the transportation of the goods.
• It is expressly forbidden to transport certain goods, including: Animals, explosive, toxic, flammable, or eminently dangerous materials, cash, coins, gold or silver, jewelry, watches, precious stones, deeds, bonds, securities, and similar items.
• Live or dead livestock, hides, fine arts, as well as all products whose marketing is prohibited by law.
• MOOVAX considers as dangerous products, in addition to those previously listed, gas, chemical, substance, material, or hazardous or toxic waste that is considered dangerous by the standards or competent entities.
• The CLIENT is prohibited from transporting any goods that imply the possibility of violating any law or regulation of a public authority, or the customs and practices observed by MOOVAX.
• MOOVAX is not responsible for delays caused by adverse weather conditions or other unforeseen circumstances beyond its control.
• MOOVAX reserves the right to modify these terms and conditions at any time without prior notice.

LIABILITY AND INSURANCE

• MOOVAX is liable for the CLIENT's goods, provided they are properly packaged and protected, during transportation to the destination, within the limits established by applicable legislation.
• MOOVAX offers basic liability insurance to cover any damage to the CLIENT's goods during transportation, unless caused by negligence, inadequate packaging, or lack of protection by the CLIENT.
• The CLIENT may optionally contract additional insurance to cover any damage to their goods, with the CLIENT responsible for informing themselves about the conditions and applicable costs.
• Any claim for damage or loss of goods must be submitted in writing to MOOVAX within a maximum of 48 hours after the completion of the service, accompanied by documentation proving the alleged damages.

CANCELLATION AND CHANGES

• The CLIENT may request changes to the date or location of the contracted service with MOOVAX, by written communication, at least 48 hours before the scheduled date for the service.
• If MOOVAX has to cancel the contracted service for reasons not attributable to the CLIENT, the company will notify the CLIENT as soon as possible and proceed with the full refund of the amount paid for the service.
• MOOVAX will not be responsible for any losses or additional expenses incurred by the CLIENT as a result of the cancellation.

CONFIDENTIALITY AND DATA PROTECTION

• MOOVAX commits to ensuring the confidentiality and protection of the personal data provided by the CLIENT, in compliance with the applicable legislation on personal data protection.
• The personal data provided by the CLIENT will be used exclusively for the provision of the contracted services and for billing purposes.
• MOOVAX will not share the CLIENT's personal data with third parties without the prior consent of the CLIENT, except when required by law or competent authorities.

JURISDICTION AND APPLICABLE LAW

• These Terms and Conditions are governed by and interpreted in accordance with Portuguese law.
• For the resolution of any dispute arising from the interpretation, execution, or breach of these Terms and Conditions, the parties agree to submit to the exclusive jurisdiction of the competent courts of the district of Matosinhos, Portugal, with express waiver of any other forum.
